Terms and conditions

1. Scope

(1) For all deliveries by Ivalox (Moritz Mösel, Am Kirchberg 9a, 83083 Riedering, hereinafter referred to as the "Provider") to consumers (§ 13 BGB - German Civil Code) via the online shop at https://ivalox.com, these General Terms and Conditions (AGB) apply exclusively.
(2) A consumer is any natural person who enters into a legal transaction for purposes that predominantly can neither be attributed to their commercial nor their self-employed professional activity.

2. Contractual Partner, Formation of Contract

(1) The purchase contract is concluded with Moritz Mösel, operator of Ivalox.
(2) The presentation of products in the online shop does not constitute a legally binding offer, but an orderable online catalog.
(3) By clicking the button to place a binding order ("Buy now" / "Order with obligation to pay"), you place a binding order for the goods contained in the shopping cart. Confirmation of receipt of the order occurs together with the acceptance of the order immediately after sending via an automated email. With this email confirmation, the purchase contract is concluded.

3. Prices and Shipping Costs

(1) All prices stated are final prices.
(2) Due to small business status pursuant to § 19 UStG (German Sales Tax Act), no VAT is charged or displayed.
(3) In addition to the specified prices, shipping costs apply for delivery. Shipping costs will be clearly communicated to you during the ordering process and on the "Shipping and Payment Terms" page.

4. Delivery and Delivery Restrictions

(1) Delivery is made to the delivery address specified by the customer.
(2) Delivery times are specified for the respective product in the online shop. Should different delivery times apply to individual products, this will be indicated separately in the shop.

5. Payment and Payment Processing

(1) The payment methods specified during the ordering process are available to you in the shop.
(2) Payment processing is carried out via the payment service provider Stripe Payments Europe, Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland (hereinafter referred to as "Stripe").
(3) When using the payment methods offered via Stripe (e.g., credit card, SEPA direct debit, Apple Pay, Google Pay, Klarna, or Sofortüberweisung/instant bank transfer), payment is processed directly via Stripe. The respective charge to your account/card takes place immediately after completion of the order.

6. Retention of Title

The goods remain our property until full payment has been made.

7. Right of Withdrawal

Consumers are entitled to the statutory right of withdrawal. Please refer to our separate Instruction on the Right of Withdrawal for details.

8. Warranty and Liability

(1) Statutory warranty rights apply.
(2) For claims based on damage caused by us, our legal representatives, or vicarious agents, we shall always be liable without limitation in the event of injury to life, body, or health, as well as in the event of an intentional or grossly negligent breach of duty.
(3) In the event of a slightly negligent breach of essential contractual obligations, liability shall be limited to the foreseeable damage typical for the contract. Otherwise, liability is excluded.

9. Final Provisions

The law of the Federal Republic of Germany applies, to the exclusion of the UN Sales Law (CISG), insofar as this does not conflict with mandatory consumer protection provisions of the state in which the consumer has their habitual residence.
